The speakers will discuss the year’s most impactful decisions in construction law.  

  • ·  8:45 a.m. : Québec Construction Industry Stakeholder Liability Is Distinct from Manufacturer Liability: Identifying and Avoiding Risks by Nicolas-Karl Perrault and Alexandre Belzile 

Québec extends the liability of manufacturers with regard to their products and related technical information. The seminar will cover the key principles of the legal warranty of quality when specific uses are disclosed , the shared liability of professionals and manufacturers for immovable works, and the presumptions applying to manufacturers regarding parts supplied. 

The presentation will focus on important recent  legislative changes impacting the construction industry, such as the Act to modernize the construction industry (Bill 51) and the Act to modernize the occupational health and safety regime with regard to prevention and worker participation mechanisms on construction sites, which include requiring the presence of a health and safety representative and a health and safety coordinator. The review of important recent penal decisions will also be discussed, particularly with respect to the liability of employers, principal contractors, owners, as well as directors and officers.

In this presentation, our speakers will present you with an overview of the Québec legal framework designed to facilitate collaborative projects.
