Overview

Gavin Cameron is a litigator in Vancouver with a focus on commercial disputes and white-collar criminal investigations. Appearing as successful counsel in more than 100 reported decisions, including more than thirty appeals, he advises on contractual disputes, shareholders’ remedies, defamation, commercial fraud, and regulatory prosecutions.

A significant part of Gavin’s practice involves acting for individuals and corporations subject to criminal and quasi-criminal investigations, implementing strategies to avoid charges, and defending their interests in court. He is lead trial counsel in a number of the highest-profile corporate criminal negligence and white collar criminal prosecutions in British Columbia.

Gavin appears as counsel in trials and appeals in all levels of court in British Columbia, as well as in the Supreme Court of Canada. He also regularly acts as counsel in commercial arbitrations.

Gavin is frequently retained by other lawyers – to represent them in disciplinary matters, defend or take their cases on appeal, and as their personal counsel in contentious matters. He is an Adjunct Professor at the University of British Columbia, where he has lectured in Civil Procedure for the past 4 years.

  • Helgason v. Rondeau, [Case - Casey Helgason], An appeal from the dismissal of liability against a driver in circumstances where the Plaintiff, a young lawyer, was significantly injured.
  • Steppe Gold Ltd. completes acquisition of growth-oriented mining company, Anacortes Mining Corp., [Deal - Steppe Gold Ltd.], Steppe Gold Ltd. completes acquisition of Anacortes Mining Corp.
  • Hootsuite succeeds in challenging Provincial taxation of cloud computing services, [Case - Hootsuite Inc.], Fasken successfully represented Hootsuite in an appeal from an assessment of provincial sales tax on the purchase of “cloud computing” services. The decision is the first to consider the definition of “software program” under the modern Provincial Sales Tax Act, S.B.C. 2012, c. 35.
  • Rigby Foods, Inc. v. B.C. Frozen Foods Ltd., 2023 BCSC 352, [Case - B.C. Frozen Foods Ltd.], Pre-judgment garnishing order in the context of e-mail ‘hacking’ dispute set aside.
  • Haug v. Funk, 2023 BCCA 110, [Case - Celedonia Haug], This appeal resulted in a clarification of the law governing allegations of failure to mitigate and awards of loss of housekeeping capacity on a non-pecuniary basis in personal injury litigation.
  • Insurance Corporation of British Columbia v. E.B., 2023 BCSC 120, [Case - E.B.], The court confirmed, and Fasken defended, the jurisdiction of an arbitrator to award a successful plaintiff in mandatory arbitration proceedings the arbitrator’s fees and expenses as an aspect of the costs award at the conclusion of the proceedings.
  • Nexii awarded security for costs against Symphony Technologies, [Case - Nexii Building Solutions Inc.], Nexii awarded security for costs in ongoing contract dispute.
  • Mount Polley Mining Corporation and Imperial Metals entirely successful in defending claims made against them and in their counterclaims brought against a contractor, [Case - Imperial Metals Corporation and Mount Polley Mining Corporation], We represented Mount Polley Mining Corporation and Imperial Metals Corporation in an arbitration regarding claims by and against a dredging contractor engaged to remove tailings which had been stored in mine pit while the tailings storage facility was rebuilt.
  • Boucher v. Bemister, 2023 BCCA 17, [Case - Timothy James Bemister], Fasken successfully defended a trial judgement in favour of a plaintiff for loss of future earning capacity.
