Toronto (Canada) — Fasken Martineau, a leading international business law and litigation firm, has advised on three transactions that were named Deal of the Year at the annual Infrastructure Journal Global (IJGlobal) Americas Awards last night in New York.
The IJGlobal Americas Awards celebrate the outstanding transactions and institutions from the world of infrastructure finance. The winning transactions on which Fasken Martineau’s Infrastructure & Public-Private Partnerships (PPP) Group advised are:
• North America PPP Deal of the Year – Pennsylvania Rapid Bridges
• North American Refinancing Deal of the Year – South Fraser
• North American Rail Deal of the Year – Eglinton Crosstown Light Rail Transit (LRT)
The Group advised the Concessionaire counsel in the Pennsylvania Rapid Bridge transaction, the largest private activity bonds issuance to date on a US P3 project. This deal will see the replacement of 558 aging bridges, with construction projected to be complete by the end of 2017. The bridges are primarily crossings on smaller state highways, many in rural areas across the state.
Fasken Martineau’s PPP Group also advised the placement agents and bondholders throughout the South Fraser transaction. This transaction saw the refinancing of the South Fraser Perimeter Road in British Columbia, a 40-kilometre, four-lane route connecting ports, rail yards and industrial areas to regional highways. This road has substantially improved transportation links for both local residents and industry, and has significantly eased congestion of existing metro roadways.
The lenders and underwriters were also advised by the PPP Group on the financing for Eglinton Crossroad LRT Project. The C$5.3 billion LRT project, which reached financial close on July 21, 2015, will run across 19 kilometers and include 25 stations. The project aims to reduce congestion and provide reliable transit to Toronto residents.
The Fasken Martineau team that advised on all three deals included lead counsel Brian Kelsall (corporate project finance), Ella Plotkin (banking and project finance), Sean Stevens (corporate/commercial), Sean Morley (project finance, PPP, infrastructure), Marc Lefler (corporate/commercial), Kathleen Butterfield (corporate/commercial, infrastructure and PPP), Louise Kennedy (corporate/commercial) and Daniel Fuke (corporate finance).
