Toronto (Canada) – Fasken is highlighted as a key player in two cases in Lexpert’s Top 10 Business Decisions of 2021/2022. The list is based on an assessment of the most significant Canadian legal cases with decisions released between Oct. 1, 2021, and Sept. 30, 2022.
Of the top ten 10 cases recognized, the Firm acted on two:

- Thales DIS Canada Inc. v. Ontario, 2022 ONSC 3166
For Society of Composers, Authors and Music Publishers of Canada v. Entertainment Software Association, 2022 SCC 30, the Fasken team led by Jay Kerr-Wilson and including Stacey Smydo, and Michael Shortt represented Entertainment Software Association, Bell Canada, Quebecor Media Inc., Rogers Communications, Shaw Communications in the dismissal of appeal brought by SOCAN and Music Canada. The Supreme Court of Canada has rejected numerous attempts by the music industry to “double dip” on internet royalties, resulting in significant savings for not only Fasken’s clients in the case but all Canadian consumers who stream music and other copyrighted works online.
For Thales DIS Canada Inc. v. Ontario, 2022 ONSC 3166, the Fasken team led by Peter N. Mantas, and including Nabila Abdul Malik, Novera Khan, Marcia Mills, and Alexandra Logvin represented Thales DIS Canada Inc. in their application for judicial review of the Ontario Superior Court’s decision that the domestic production requirement in Ontario’s bid-request process was counter to the Canada-European Union Comprehensive Economic Trade Agreement (CETA). Ontario’s Divisional Court quashed the RFB and the decision to dismiss Thales’ challenge.
