Overview

Traditional stores are being overshadowed by virtual showrooms. Online retailers are creating endless new possibilities for the consumer. Real estate prices and labour costs are rising. Some chains are capitalizing on the value of the real estate. And some chains are losing the battle.

We negotiate commercial contracts, including retail leases for all types of locations, as well as handle construction, distribution requirements, product labeling, marketing and advertising, privacy, trade mark matters, licensing, employment and pay equity, to name a few.

Canadian and foreign product labels often require specific language, as does signage, website copy and consumer protection verbiage on receipts. Allegations of anti-competitive behaviour and price fixing can seriously impact consumer loyalty; our lawyers help retailers adapt marketing practices to local regulations and are well regarded for their defense of client interests and reputation if disputes arise.

The nature of retail business means that labour, employment and privacy issues can crop up quickly. Our advice is customized to the unique needs of employers whose human resources span multiple locations and languages, and who benefit from consistent, but logical, implementation of corporate policies and regulations wherever they operate.

What distinguishes our firm is the truly national scope of our resources and experience; we have lawyers in every office who know the local regulations and are well-versed in national and international business. Our clients include retailers whose industries span fashion, groceries, restaurants, including major coffee shop chains, cosmetics and beauty, pharmacies, hardware and many other sectors.

Fasken’s retail team is recognized for its work on some of the largest insolvency and restructuring proceedings involving retailers in Canada and the most successful cross-border expansions.
