Fasken Martineau acted as legal advisor to the Ministry for Energy of the Democratic Republic of Congo as part of the review and adoption of its bill respecting the national power code. In the context of this mandate, the firm drafted, implemented and applied a new national power code, the Code National de l'Électricité, with a view to integrating the network of the Central African Power Pool in partnership with USAID. We advised the staff of the Ministry for Energy as well as members of its technical support team and the infrastructure sub-commission on the examination and analysis of the provisions proposed in the bill, such as the level of powers granted to the regulatory agency in the context of the implementation and application of the new national power code.
