On June 14, 2013, the Ontario Court of Justice acquitted Seaway Marine Industrial Inc. (“Seaway Marine”) of all charges laid against it. The Ontario Court of Justice confirmed that Seaway Marine did not breach any obligations under the province’s Occupational Health and Safety Act, and that it took precautions reasonable in the circumstances to protect its workers. A team of Fasken Martineau lawyers composed of Neal J. Smitheman and Antonio Di Domenico represented Seaway Marine at trial.
