After the succession had been considered vacant for several years, we represented a group of heirs from the paternal line in order to claim the residue of the succession held by the Agence du Revenu du Québec. The Agence refused to pay half of the succession (50%) because it wanted to keep this amount in case there was a claim from any heirs from the maternal line, which could have involved very long periods. After the Superior Court ruled in our clients’ favour, the Court of Appeal considered the issue and determined that the evidence adduced by our clients was sufficient to justify paying out the full amount of the succession.
