On January 7, 2015, Justice W. Matheson of the Ontario Superior Court of Justice ruled in favour of Nordion in dismissing LIFE’s main defences in the action, namely res judicata and abuse of process. With respect to the underlying merits of the case, Her Honour referred to an arbitrator the initial jurisdictional question of whether Nordion’ s claims could continue to be pursued in Court or had to be arbitrated. The dispute, in which Nordion seeks recovery of U.S. $30.5 million from LIFE, arose from the dissolution of a joint venture between the parties in respect of the manufacture and sale of mass spectrometers.
