Rougemount Capital Inc. v. Computer Associates International Inc., 2016 ONCA 847

On November 10, 2016, the Court of Appeal for Ontario ruled in favour of Computer Associates International Inc., allowing its appeal from a trial judgment in the amount of $11-million for breach of contract. The Court held that, in the circumstances of the case, the trial judge had erred in departing from the general presumption that damages should be assessed as of the date of breach.
