Fasken assisted a China-based investor with the structuring and negotiation of three limited partnerships to finance the acquisition of student residences in the Waterloo region of Ontario. The acquisition involved coordinating the redemption of an existing mortgage and the acquisition of clear title as part of contentious, court monitored receivership proceedings. In connection with the investment, Fasken negotiated the related limited partnership agreements, shareholders’ agreements and advised on the flow of funds into Canada to achieve certain estate planning and tax efficiencies.
