Fasken represents Google in overlapping proposed privacy class actions commenced in British Columbia, Ontario and Quebec.

The claims allege that Google violated the privacy and property rights of proposed class members by collecting their personal information and using it to sell advertising without their consent. The various actions advance claims including intrusion on seclusion, breach of statutory privacy torts, conversion and trespass on behalf of proposed class members. The plaintiffs seek compensatory, symbolic and/or punitive damages, as well as disgorgement of Google’s profits. Certification and authorization will be vigorously defended. 

Class actions of this scope arising from the alleged collection and use of personal information by a technology company are novel in Canada.
