In October 2018, Fasken was retained by the Canadian Broadcasting Corporation to intervene in a reference procedure in front of the Federal Court of Canada brought by the Privacy Commissioner of Canada.
The Federal Court is asked if the Personal Information Protection and Electronic Documents Act (PIPEDA) applies to search engines like Google, and may ultimately have to determine if a "right to be forgotten" like the one recently adopted in Europe exists in Canada.
