Following the Quebec government's order to suspend classes in the province's schools on March 13, 2021, students from 15 Quebec universities have filed a request for authorization to institute a class action, claiming "a restitution of their benefits" by their institution of a portion of their tuition fees for the session interrupted by COVID-19.
The class action against Quebec universities alleges that the cancellation of in-person courses throughout the province resulted in students losing access to essential learning services, that the measures put in place at most universities were insufficient, and that the quality of instruction was significantly inferior to what they were entitled to receive. In addition, the class members claim that they could not access all the services they paid for under the university contract and are seeking compensation of $30 per credit.
A Fasken team composed of Maxime-Arnaud Keable and Christian Trépanier advised a Montreal university in connection with this case.
