Fasken successfully represented the Festival d’été international de Québec inc. (“FEQ”) in an intense legal saga in which the defendant filed an application to oppose the sale of a building acquired by way of a sale under judicial authority, which was rejected by the Superior Court after a hearing.
Permission to appeal this judgment was subsequently refused by the Court of Appeal. Despite these victories before the courts, the FEQ then had no choice but to subsequently file an application for injunctive relief against the defendant, which was granted by the Superior Court at both the provisional and interlocutory stages, thereby putting a definitive end to the litigation.
