ACT Greenwood Ltd. (“ACT”) and its principal operated medical clinics and contracted with an outside doctor to provide care at some of its locations. The relationship with the doctor broke down and the doctor began work for a different medical clinic operator.
ACT sued that physician, claiming she breached a number of contractual terms, including the non-competition provision. The initial action was dismissed but the appeal was successful in part, in respect of a claim for underpayment under the contract.
