Fasken advises a publicly-traded technology company on a variety of immigration matters, including overcoming criminal inadmissibility through a rehabilitation application.

A key technical services employee possessing unique proprietary knowledge was required to enter Canada to provide specialized technical services to a Canadian client, but was denied entry due to a prior criminal conviction. In a complex written submission, we were able to satisfy the immigration authorities that his personal circumstances and the benefits of his entry to Canada were sufficiently compelling to warrant the granting of criminal rehabilitation. The application was successful and the individual is no longer inadmissible to Canada. He subsequently applied for and received a work permit allowing him to perform the technical services requested by the company’s Canadian client.

Fasken also advises this company on exemptions from the work permit requirement for business visitors performing after-sales service at Canadian client sites and on work permit applications for employees possessing advanced proprietary expertise.
