An individual (the “Respondent”) who entered a joint venture agreement for property redevelopment, found themselves in a dispute over an unpaid loan guaranteed by their joint venture partner (the “Appellant”). Despite the property's sale, the Appellant failed to fulfill their financial commitment, leading the Respondent to seek legal recourse.
The Respondent secured a summary judgment in their favour at the Ontario Superior Court. This judgment was successfully upheld at the Ontario Court of Appeal, mandating the Appellant and the involved company to repay the Respondent the full loan amount in addition to prejudgment interest.
