Represented Nortel before various courts

Mtre Bernier has represented Nortel before various courts, including the Court of Appeal of Québec in a litigation bearing on the right of employees to continue working for their employer despite a partial alienation of the undertaking operated by that employer. This case tested the scope of employees' individual rights in the context of the protection set out in the Labour Code for the maintenance of collective labour agreements and the rights of succession resulting therefrom in the case of the sale, concession or restructuring of a business. This decision is now authority.
