Terry Kyle Lapierre (he/him) is a partner in the Labour, Employment and Human Rights practice group in our Québec City office.
Terry Kyle – or TK to those who know him – is known within the field for his top-level professional excellence and his pride in providing clients with strategic legal advice based on a holistic approach that leaves no stone unturned. TK’s reputation for responsiveness and for innovative solutions earned him the distinction as “One to Watch in 2022” by the Best Lawyers in Canada, a directory consisting of top peer-nominated lawyers.
TK advises clients across Canada and abroad in connection with all matters of labour and employment law in Quebec. and does so with flawless proficiency in both English and French, whether spoken or written. TK has a unique “hybrid” practice which focuses on both private and public sector M&A as well as employer-side litigation.
TK works closely with the deal team to advise buyers and sellers on all issues related to labour, employment, pensions and benefits that arise in the context of large-scale commercial transactions (including share deals, asset deals, amalgamations, corporate reorganizations and financing). TK has a particular strength for contract negotiation and drafting, and he regularly advises clients on executive employment agreements, executive compensation and termination of executive employment.
As a litigator, TK has an exceptionally high success rate in employer-side litigation. He has been successful in defending clients against material claims of constructive dismissal, discrimination, retaliation, wrongful termination and harassment. TK has appeared before labour arbitrators, administrative tribunals, superior courts and the Federal Court of Appeal. Moreover, his experience has been solicited in connection with appeals at the Court of Appeal of Québec and even the Supreme Court of Canada.
In addition to his “hybrid” practice, TK acts as a trusted business advisor to his clients on issues ranging from French language rights to complex employment law matters in Quebec. Moreover, through his vast network, TK easily coordinates for his clients where inter-provincial and even international advice is needed. His client roster includes airlines, banks and financial institutions, manufacturing companies, private equity firms, investment funds, technology start-ups, established technology companies and insurance companies.
TK is particularly passionate about matters relating to Equity, Diversity and Inclusion. He is a member of the firm’s national EDI committee, he is a member of the firm’s recruitment committee, he actively participates in the firm’s national Pride Network and he is a past co-chair of the Canadian Bar Association’s Quebec branch of the Sexual Orientation and Gender Identity Conference (formerly known as “SOGIC”). TK has also devoted his time to pro bono representation of certain non-profit organizations dedicated to the LGBTQIA2S+ communities.
In his personal time, TK is a prolific singer and musician who once appeared on national television as a semi-finalist on Canadian Idol and who continues to nurture a passion for music today.
Before joining Fasken, TK practised labour, employment and pension law at a top international firm. Prior to that, TK practised civil, commercial and tax litigation at another top national firm.
