Mining projects in foreign countries present their own set of legal challenges and risks, more particularly with recent shifts in the global investment landscape. Host states have been trying to increase their take from their natural resources in various ways - e.g. new or increased taxes/royalties or ownership requirements, etc. “revisiting” of existing contracts, cancellation of licenses/permits, etc.

Such government actions - tagged as resource nationalism and identified by Ernst & Young as one of the top business risks facing the mining and metals sector in 2013 and 2014 - can seriously affect mining projects, especially in light of uncertainty about commodity prices and demand and the global economic crisis.

A multi-disciplinary panel will look at these issues from a practical standpoint and discuss their impact on Canadian stakeholders in international mining projects. They will provide an overview of recent reforms/changes and discuss possible strategies to mitigate risks and to finance and manage disputes.
