On June 23, amendments to the Competition Act will come into effect.
These amendments, which apply across Canada, will namely prohibit wage-setting and no-poaching agreements between employers, whether they are competitors or not. These agreements, in which two employers agree not to solicit each other's employees, could constitute a criminal conspiracy subject to severe penalties. Additionally, these new provisions could have significant civil consequences for employers' activities.
From this seminar, employers will gain practical advice and increased knowledge of situations that may constitute a violation of the Competition Act and the impact on their business.
During the session, we will explore the following topics:
- Amendments to the Competition Act and statutory defences available to employers;
- Situations that are not, at first glance, covered by the legislative amendments, as interpreted by the Competition Bureau;
- Civil and criminal consequences of these new provisions;
- Best practices to be implemented by employers.
