Overview

On March 21, 2023, the Québec government tabled Bill 16, An Act to amend the Act respecting land use planning and development and other provisions. This is the first step in a broader reform announced by the Québec government aimed particularly at favouring municipalities and other public bodies in the context of formal or disguised expropriations. However, while the bill is currently silent as to certain elements that have been widely discussed in the media, it contains several other provisions that should concern developers and landowners.

At the Fasken Institute on June 7, 2023, our speakers Nikolas Blanchette, Guillaume Pelegrin and Frédéric Legendre will address some of these concerns by answering the following questions:

  • What is the new “incentive zoning”?
  • What will be the new authority to prohibit interventions that may cause water supply or treatment capacity issues?
  • What entails the new authority to subject the issuance of a municipal authorization to the production of an expert opinion?
  • Are there any changes to the rules regarding disguised expropriation?
