Overview

What might happen throughout the life of your lease? Business conditions and plans fluctuate. Negotiation of commercial leases warrants careful consideration of long-term requirements. Clients must look beyond the term and the rent.

We work on all aspects and types of commercial leasing matters. This includes all documentation related to the leasing of retail, office, multi-use and industrial premises. Our team has particular experience in sale/lease back, flagship space leases and build-to-suit projects. Institutional landlords look to us for assistance with the redevelopment of shopping centres, exercise of options and rights of first refusal as well as buy-back of anchor leases. We assist tenants with their expansions across the country, through acquisitions and, or development Fasken structures leases to respond to very precise - but changing – market requirements. This provides a measure of security to both landlords and tenants throughout the term of their lease.

If a dispute arises, we’ll provide advice on default, termination, landlord/tenant rights and remedies, lease interpretation and enforcement.

Our real estate team is nationally recognized for its expertise in complex leasing arrangements. We work for key industry players in North America and are skilled at national-level lease negotiations geared to reflect the strategic goals of our clients.

Fasken lawyers are deeply involved in respected industry associations, including including International Council of Shopping Centers (ICSC) and Commercial Real Estate Women (CREW) Network.
