Humber River Health, a leading integrated health network in the Greater Toronto Area, faced a grievance filed by the National Organized Workers Union (the “Union”) claiming that its mandatory COVID-19 vaccination policy was unreasonable.
The matter was taken to arbitration, where the Union’s policy grievance was dismissed. The arbitrator ruled that the policy was reasonable and discipline including discharge for cause could be an appropriate remedy for failing to vaccinate in a critical care hospital.
