Overview

Client

Thales Canada Inc.

Thales Canada Inc. is part of the Thales Group, a large French public corporation that supplies aircraft systems. Thales has now instituted proceedings of over $30 million against Bombardier for damages suffered after Bombardier unilaterally cancelled the LJ-85 program and contract. Thales had previously won in the Court of Appeal, thereby preventing Bombardier from hindering the $1.8 millions claim on account by including other proceedings in the same file.

Thales Canada Inc. sued Bombardier Inc. after Bombardier decided to end the Learjet 85 avionics program.

This lengthy major commercial dispute has been highly publicized. It is the only time an aircraft manufacturer has completely ended an avionics program allegedly based on the lack of sales before the aircraft production phase had even started.

A Fasken team led by Eric Simard and composed of Vincent Cérat Lagana, Camille Duguay and Jean-François Trudelle represent Thales in this file.
