Fasken represented Gatos Silver, Inc. (“Gatos”), a U.S.-based silver mining company, in connection with a class action proceeding by its shareholders. On January 25, 2022, Gatos announced that there were errors in the company’s technical report including indications of an overestimation in the existing resource model. The plaintiff claimed that Gatos made misrepresentations in its disclosure associated with two public offerings of its shares.
On June 28, 2024, the Ontario Superior Court of Justice approved the settlement of the plaintiff’s action against Gatos, without admission of liability by Gatos.
